Working Policy

A non-refundable booking/retainer fee as well as full acceptance of the terms and conditions as written in this Contract secures the time and services of the Photographer for the wedding and is non-refundable or transferable in the event of cancellation on the part of the client. The booking fee is deducted from the full cost of the Clients chosen package and payment in full of the remaining balance will be due one month before the wedding day. Weddings that are postponed to a later date will retain the fee as long as the photographer can re-schedule for the new date and time (see 1.4 and 1.5)

The Client agrees to book the Photographer for services outlined at the bottom of this contract. There is the option to upgrade a package and/or services by adding an engagement shoot, a photo album or extra hours, agreed in writing by The Photographer at least 4 weeks prior to wedding date. The Client agrees that they cannot downgrade the booked services to less hours than is stated on this contract.

The details of the wedding schedule are to be agreed beforehand in writing via email. The Client shall notify the Photographer of any changes to these details in writing. The Photographer cannot be held liable for delays or disruption in their delivery of the service until any changes are received, and acknowledged in writing. The client agrees to confirm the schedule at least one-week prior to the wedding and notification of any changes in schedule or location must be made in a timely manner.

In the unlikely event that the assigned Photographer is unable to perform to the guidelines of this contract due to an injury, illness or other cause beyond the Photographers control, Terence Meghani Photography will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the wedding. Terence Meghani Photography takes the utmost care with respect to exposure, transportation and processing the photographs, however, in the unlikely event that the digital files have been lost, stolen, or destroyed for reasons beyond the control of Terence Meghani Photography, including but not limited to camera, hard drive, or equipment malfunction, it will result in the return of a reasonable percentage of payments received for the event.

A signed contract and booking/retainer fee are required to reserve the dates and times of the wedding. The Client has the right to cancel contract within 14 days of signing and will receive a refund of the retainer fee. After the 14 day cooling off period, if the Client should cancel the Event for any reason, the fee will not be refunded. The Client may cancel this contract at any time by giving written notice to The Photographer but in doing so shall forfeit the retainer fee. Cancellation (with the exception of severe circumstances) less than 12 weeks before the wedding will result in the payment in full becoming due. All cancellations must be in writing.

Should the Client need to postpone their wedding to a later date, the Client should liaise with the Photographer about the potential new date/s to check their availability before booking a final date with the venue to avoid losing the Photographer. If the Photographer is unavailable on the new date, the retainer fee will not be refunded and the Photographer will find an associate to photograph the event on their behalf. The photographer will then edit the associate photographer images in their own editing style and deliver the images themselves. Postponements made NOT in conjunction with COVID-19 will incur a postponement fee of £350.

In the instance of Government restrictions banning weddings due to Covid-19 or similar, the Photographer agrees to be flexible and move the couples wedding date free of charge, waiving the postponement fee and cancellation policy above, and for the same rate as stated on this contract within 12 months of the original wedding date. For postponements further in advance than the original wedding date stated on this contract, The Photographer’s current rates will apply for the chosen year. The couple agree to check the Photographer’s availability for any new wedding date before confirming with the venue and other suppliers as per the Postponement clause above. In the instance of Government restrictions meaning weddings can go ahead but at limited numbers the Photographer agrees to waive Booked Services clause (see 1.2) and discuss on a case-by-case basis for required photography coverage. All amendments to postponed wedding dates can be done so in writing via email with agreement from both Client and Photographer.

The Photographer and the Client agree that cooperation and punctuality are essential to accomplish the goals and wishes of all parties. Shooting commences at the scheduled start time and ends at the scheduled end time. If the Client does not arrive at the appointed time for the wedding, shooting will commence at the scheduled start time and end at the scheduled end time and any additional time beyond the scheduled end time will be added at the Photographer’s discretion and billed to the Client.

The Photographer is not responsible for compromised coverage due to causes beyond the control of the Photographer including but not limited to obtrusive guests, lateness of the Client or guests, weather conditions, schedule complications, incorrect addresses provided to the Photographer, rendering of decorations, or restrictions of the locations. The Photographer is not responsible for backgrounds or lighting conditions which may negatively impact or restrict the photo coverage. Weather permitting, the wedding photographs will be taken as agreed. In the event of rain or snow or any form of weather disturbances, the photographer will make the necessary changes in the photographic session and will not be responsible for any disappointment caused by the weather. The Photographer is not held liable for missed coverage of any part of the wedding and the Photographer will not be held accountable for failure to deliver images of any individuals or any objects at the wedding.

The Photographer is limited by the rules and guidelines of the location(s) and site management. The Client agrees to accept the technical results of their imposition on the Photographer. Negotiation with the officials for moderation of guidelines is the Client’s responsibility; the Photographer will offer technical recommendations only.

The Photographer reserves to right to terminate coverage and leave the location of the wedding if the Photographer experiences inappropriate, threatening, hostile or offensive behaviour from person(s) at the wedding; or in the event that the safety of the Photographer is in question.

Where the Photographer/s will work 10+ hours during the working day (travel time, on-site attendance etc), carrying heavy camera equipment and walking on average 6-8 miles during the day the Client agrees to pay for the Photographer/s to have a hot meal during the day. Provision must be made with your venue or caterers to provide the photographer/s with a hot meal as soon as possible during the wedding breakfast (this is not usually taken with your guests as the photographer has other important duties to perform during this period and usually takes this time to rest). Where coverage includes up to mid-evening then a second light meal should be available. Where coverage has been agreed to include a second photographer then the same conditions apply to this individual. Where provision is not made the photographer reserves the right to take appropriate rest, food and drink breaks as when required throughout the day. Please note this may impact your wedding photography coverage.

Please be aware this does not apply if the Client has booked the Photographer/s for less than 6 hours using the hourly rate system.

The photographs produced by the Photographer are protected by Copyright Law (all rights reserved) and may not be reproduced in any manner without the Photographer’s explicitly written permission. If the Client has purchased a photography package from the Photographer, upon final payment by the Client, limited copyright ownership of the resulting images will be transferred to the Client and the Photographer grants the Client permission to share the images on social media, with family and friends, and on vendor websites as long as the images remain unaltered and textual credit is explicitly given to the Photographer. The Client must obtain written permission from the Photographer prior to publishing or selling the photographs.

The Client hereby assigns the Photographer the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included, for editorial, trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same without restriction. The Client releases all claim to profits that may arise from use of images.

The Photographer is not liable to deliver every image taken at the event. The determination of images delivered to the Client is left to the discretion of the Photographer.

The final post production and editing styles, effects, and overall look of the images are left to the discretion of the Photographer. No unedited or RAW files will be sent to the client.

If the Client wishes to order a photo album of their images from the Photographer, the Client must choose 60 images from their gallery and the Photographer will design the 64 page/32 spread book around these chosen images including more from the gallery. The Photographer will send the Client a PDF to make sure the Client is happy with the layout and design. Should the Client be unhappy with the final layout, the Photographer will make TWO further revisions to the album with the Client’s notes before the album is printed. Photo albums, depending on how many revisions are made can take up to 7 weeks to be designed, printed and delivered.
